強行法規（きょうこうほうき）とは、法令の規定のうちで、それに反する当事者間の合意の如何を問わずに適用される規定をいう。強行規定ともいう。
契約などによって変更することが認められている規定をいう「任意法規（任意規定ともいう）」と対になる用語である。


強行法規に反する契約などの合意は法律行為として無効となる。



概要


通常は、公序良俗に関する内容など、それに反する合意をすることが内容的に認められるべきではない場合に用いられる。(したがって民法90条は強行法規の代表例といえる。)例えば、契約の双方当事者の立場の強さの違いに基づいて、弱者保護のために用意された規定については、それに反する合意を当事者間が行うことを認めるならば保護規定を置いた意味が減殺されてしまうことから、通常、強行法規として理解される。


当事者間の合意を補完する目的で用意されている規定であって一般には、公益保護を目的とした規定は強行法規であることが多く、そうでない場合には任意規定の場合が多いといわれる。


法令上は、強行法規と任意法規は混在しており、強行法規や任意法規であることが明示されているとは限らない。具体的に各規定について強行法規性が認められるかどうかは、その規定の解釈の結果、結論が導かれている場合が多い。また、いかなる任意の修正を許すかの範囲についても広狭がありえる。例えば、日本の借地借家法の一部の規定は、借り手に有利な特約は許す「片面的」強行規定としての性質を有することを明文によって明らかにしている。


強行法規違反の行為には罰則が設けられている例があるが、必ずしも刑罰の有無と強行法規性が対応するものではない。



国際私法と強行法規


公益性の強い強行法規（労働法による規制など）は、公法と同様に、当事者による準拠法選択の如何を問わず適用される。このような強行法規を絶対的強行法規という。
一方、そうでない強行法規は相対的強行法規と呼ばれ、当該強行法規の属する法が国際私法によって準拠法として指定されたときのみ適用される。

Can't connect RFCOMM socket: Host is down
